I have read in several forum that one cannot form own company and sponsor H1 through that. The logic is sponsoring H1 is work and you cannot work without H1.
I think it is acceptable logic. Otherwise many would have sponsored H1 for self.

USCIS could be making a determination that the 140's company is now revoking were approved iun error and people are not eligible for ac21.
If it is determined that that is indeed why they (USCIS) denied a certain 485, and then the applicant proceeds to hire/seek the help of competent lawyers and accounting professionals (I�m not naming anyone here :)) to file an MTR where the old employer�s ability to pay for that particular employee (from the time of filing the labor until the employee left the old employer/submitted AC21 documents) is demonstrated via the employee's W-2s, do you think the applicant has a chance to get the 485 re-instated?
I'll keep everyone posted of what happens to this case.

India has not moved an inch (may be has retarded in its growth) forward when it comes to quality of life or individual freedom or Govt.-public relationship. You can't do just with money. Money doesn't buy everything one need for a peaceful,happy life.
And, an individual or a group in India cannot fight against anything that is evil in India. The option for people is to go places. So, the politicians are responsible. I am not surpirsed by your question "how come the 'inncoent' politicians responisble?" because Indians' thoughts have changed so much that we accept and expect politicians to be evil, corrupt, inhuman etc. I mentioned people as smart in irony and I am sorry that you couldn't understand that!

My wife appeared for Visa interview on 6th and yet to receive the passport. we booked tickets for this weekend and seems we have to reschedule. I sent a mail to NIV and no response as of now.This is of concern. can anyone tell me about the normal turnaround time for H4 Visas these days?

I just got hold of one of the consulate staff and she told me that they are having some problem with PIMS database for background check and there is delay in processing passports. The lady I spoke assured me that, latest by Mon/Teusday of next week, we can expect passport. I will try to reach vfs in the evening and see what they say..

I got back through JFK. Had Valid H1 and AP. Unfortunately (kicking myself) , my EAD was insidethe passport too. IO saw it n said you'll need to use AP and took us to interview room, no questions asked, but took another 25 minutes. Now am Parolled... and I94 says Parolled until .....
Moral of the story : If you have valid H1 stamped , keep the AP tucked away. Can't argue with the ignorant mo fo s at the counter..

Can we each leave a 'personalized note' on how much we have contributed in Federal / State / Social Security taxes + Medicare / etc.???? Even a rough order estimate... to get them to listen to us seriously.

2. Collect the data (anonymously, of course) and send a written brief to each Senator in that state - making a clear economic case to how we contribute
3. Collect the data (nationally, with statistical analysis thrown in) and send a written brief to all Senators - making a case at a national level.
We need eye-popping numbers, charts and quotes ... to continue the PR around high skilled immigrant needs.

ok, I did not take private coaching (not that its relevant to a 3/4 year degree) and we had quite a few lower-middle class students in engineering.
As for poor families - A MCA at IGNOU costs a little over $1000. I'm sure its similar in other distant learning courses too.
that may be the case...but maybe the guy couldn't afford the 4 year engg...did the way way cheaper 3 yr bachelors...then worked ...made some dough...decided to study further to advance...so did MCA ( repeating a 4 yr bachelors is not sensible or economical at this point)
This is all speculation ofcourse...the point is we don't fully know the person's circumstances and should not judge based on face value of the degree...if the person is talented he/she will be retained by companies who want to keep them.

But i bet you ..you will find your self in the same situation of agony and endless waiting for the final Green card.
I bet most of the people don't use your ead and AP as it puts you in a gray "Adjustment of status". They are good to have though. But you will see...how painful it is to decide to use them or not..
What i want to say is that being able to apply for EAD and AP is not the end of the battle..you will be stuck in a depressing situation waiting for the final green card.How do i know? .. I went through it...waiting for GC for the past 4 years.
I dont know its FBI or its just the USCIS incompetence but waiting in the final stage is horrible. Every time you travel you are scared...AP as for as my lawyer goes IT does not guarantee 100% entry in to the country.
After you apply for AP its only 1 year H1 increments.
What i am saying why dont we try for the overall improvement of the GC processing. Why dont we be firm about not wasting the GC numbers and recapturing the unused numbers.
We had a small revolt (peaceful way) and its successful.We dont want to stop there.

Below is the text for Waivers.. My understanding is that if end Client gives a letter to DOL stating that they don't layoffs due to this H1B and it is a temp. labor requirement etc.. It is still harsh considering anti-immigration climate.. What is feared asked in a Visa interview will be asked by DOL for extensions. So, H1B can't be on an auto-pilot mode..

Never mind the spillover, can ROW just get its normal quota at least?

Since this discussion has been going on for 5 pages, i thought ill add my 2c.
Firstoff i haven't gone through all 5 pages so if someone already mentioned this, please don't jump on me. You can create an SBI account called SWIFT account. They will give you an account number and a SWIFT code for the bank.
You can then initiate a wire transfer from any bank in the US. They charge a flat rate of around 35-45$. The good part is, you can have the money sent in $ to your local account. They say it takes 3 days but it never takes more than one day for me.
The money is saved in FD as dollars and earns you interest if you leave it for 11 months. If you need to convert it any time, you have to forgo the interest (as with any FD) and you can get the closing exchange rate of the previous day.
This has many advantages
1) one simple fee of 35$
2) In case you want to bring back the money to the us, since it is kept as dollars, you can transfer it back without any hassle. (To keep it in dollars , you may have to provide this as a special instruction)
3) Folks back home have control on exchange rate, they can cash it any time it is high
4) Takes less than a day in most cases.
If you do the math, you will see that this is better than icici when you are sending 4000$ or more approx. icici does not take fees upfront but they always give you almost 50p less than exchange rate.
I have used this 4 times so far and its very reliable.
