So you made use of this opportunity and you are asking others not to do what the law allows them to?...
fyi.. I am an EB2 I candidate and fyi… I did not port but I will not stand in the way of people wanting to get out of the clutches of those employers who act cheap.
Please read back and point out where have I expressed my discontent for date porting?
Also, I would not stand in their way but I am trying to express the fact that they themselves chose to agree to the terms in the offer letter. Let me clear out that it stands for every candidate who wanted to apply in a higher priority group be it EB3 or EB2.

There is nothing to enforce. If there is any, they would have enforced long back. It is too broad. But increasing fees won't make any sense. They have to correct the law, not imposing higher fees to everyone.
1.Audit the companies that are suspected to abuse the H1B program i.e. enforce the laws that are already in existence.
2.Impose heavy fines on these companies.
3.Use this money to cover the costs of auditing and enforcing the laws.
How will raising the H1B fees for everyone in a blanket fashion address the current "abuses"?

i am with you. we should request that USCIS recapture unused visas!
Guys , I think this issue has been discussed lot of times.
1) USCIS do not allot immigrant visas, It is alloted by DOS.
2) DOS needs a fix in the current EB laws to capture unused visa.
3) I am not sure if we can push any change in law, given the current Iraq war quagmire.
But I hope they speed up the overall application processing times, with all the increased Fee money they will get from July 30th (by investing money on IT).

Why do you bring Malice with you, everywhere, seriosly how does your family stand you ?
I have seen your posts earlier, they are full of abuses, unjust full of most useless comments, let me tell you one thing, it is a very well known truth people who are most abusive on cyber space, are most fattoo & have been beaten up kind of people because they spend their life in threat but on cyberspace they become Lion. You are a typical Cyber Sher... But in real life I can guess....
mirage,
This is very interesting. "A friend" just sent me a message telling me that you had a conference call few days back. In that call, this is what you had to say, and these are your words and I quote -
"I do not have much knowledge of political system in US. I do not understand much of the politics here. That guy with a changing hat, sanju, he seems to be very knowledgeable about the politics and current affairs. I will contact him to seek his help."
Now I am totally confused. In private phone conferences, out of everybody on this forum, you can single me out and describe me just a fewdays back as "very knowledgeable about the politics and current affairs", but your post in the public forum above says "you bring Malice", "unjust full of most useless comments", "most fattoo", "spend their life in threat but on cyberspace they become Lion", "typical Cyber Sher".
Can you first debate yourself and decide which one is it? "very knowledgeable about the politics and current affairs" or "most fattoo"? :p

Grassley Is Off the Mark (http://online.wsj.com/public/article/SB119465330149488684.html) Wall Street Journal, Nov 10, 2007
Sen. Charles Grassley (R., Iowa) apparently didn't read your "The Grassley Visa Tax "editorial of Nov. 2 ("Investing in America, Making Things Worse," letters to the editor, Nov. 8). His first two paragraphs made statements that were blatantly false. Spoken like a true politician.
No successful business hires an H-1B visa holder just to fire an American worker. Because of the shortage of trained and competent workers, high tech workers are paid the prevailing wage rates. Sen. Grassley is overlooking the term of the H-1B visas. No business wants to train a worker who will leave in a short time. Successful businesses are built on the expertise of long term experienced workers. H-1B workers are attractive because there are not skilled Americans available.
Sen. Grassley should consider the interests of the country as a whole instead of pandering to special interests and he should consider legislation to improve the performance of Americans instead of making false accusations to polish his image.

In War on the Middle Class (http://www.amazon.com/War-Middle-Class-Government-Business/dp/0670037923) Lou Dobbs says H1B workers don't pay taxes.
However, H-1B workers are legally required to pay the same taxes as any other US resident, including Social Security and Medicare. Some H-1B workers are not eligible to receive any Social Security or Medicare benefits unless they are able to adjust status to that of permanent resident. However, if their country of citizenship has a tax agreement with the United States, they are able to collect the Social Security they've earned even if they don't gain permanent residency.
In some cases, H-1B workers pay higher taxes than a US citizen because they are not entitled to certain deductions (eg. head of household deduction amongst many others).
Indian techie slams CNN Lou Dobbs! (http://www.indiadaily.com/editorial/10-28a-04.asp) By N. Sivakumar, October 28, 2004
In a book titled "Dude, did I steal your job? Debugging Indian Computer programmers", the author, an Indian software engineer, has slammed Lou Dobbs of CNN for calling the foreign high-tech workers as non-tax payers, and humiliating the enormous contributions of foreign high-tech workforce to the American economy.
"Foreign high-tech workers who come here on H-1B / L1 visas pay every tax that U.S. citizens do, including Social Security and Medicare. But if they return to their homeland, then they will not get any benefits from these programs. The recent recession cost the United States more than half a million foreign high-tech workers who had to return home after paying all these taxes. In fact, Americans owe them money"
The author writes.
"The ignorance to mention the stupendous contributions of immigrant high-tech workers was the primary cause for the anti-Indian atmosphere which is seen among computer professionals lately. Unfortunately, neither the media nor the public understand the foreign high-tech workforce. The net result: those who supported the foreign high-tech worker programs have taken a back seat to play safe, and Indians and others who came here on visas, and worked their butts off to make this country prosper are named 'slaves', 'dummies', and 'enemies'. writes the author, N.Sivakumar.
The book also claims that bringing in foreign high-tech workforce at the right time was the primary reason for America's stupendous high-tech success, and gives statistics and evidence to prove that hadn't America acted quickly, the Europeans would have taken over the software dominance.
The book also outlines the life, struggle and achievements of Indian programmers in America with entertaining facts, and is a prime discussion topic in many anti-outsourcing and immigration websites lately.

is not right.
The hardships we have chosen to enter united states and struggle here is of our own choice. It was an option. You can come to office at 9:00AM and leave by 6:00PM. No body asks you to stay late unless you work for a consultant. No body asks you to relocate unless you again work for a consultant.
You could easily get a legal immigration if you opt an easier path 'Marry a local'. So, again you have opted a hard way of going through labor certs, I-140, I-48 etc.
We all have options and it depends what you choose.
Just because few centuries ago someone entered this promised land just like that, you can't expect that to be existing now or atleast a modified version of it now.
Again, i believe the immigration system can be improved only if senators can taken into confidence about our hardships. Striking the way illegal mexicans did and or raising slogans like 'immigration is a right and not a privillege' may play against us.

Moreover, if you look at the history of past such movements( LOL ), this is 180 degrees inverse of those successful movements.
I'm a firm believer in GC success through lobbying.

IV tracker shows 3000+ EB3-I applicants, however, it is not a good tool to make analysis off of. The sorting function does not consider month-year combo. Anybody knows how to download the data to run your own post processing??
The tracker has more than 6000 entries with missing "Nationality" and "Country of Chargeability" filelds for EB3 applicants. Assuming the majority to be from India, the actual EB3-I entries may exceed well over 9000 and it is a pretty good sample size.

Yes amitjoey. thanks a lot for that help. I wish more people participated in it. infact if more members can continue to do it today it will be very helpful. yesterday there were at least 3 mails from reporters expressing interest in us. This was because a few people wrote to them about IV and requested them to do a followup article abut us. I had found about 72 articles yesterday morning and we had more than 50 potential reporters to contact. It is not easy to get press coverage and this is one opportunity where we can captitalize on the venture captitalist story (no pun intentended).
Can we know names of these reporters who wanted to know about us? Also, is there any update on what QGA is doing on getting the word out about IV to the lawmakers? In her response to me, Clinton did not appear to indicate any knowledge of the severity of the problem that legal immigrants are facing due to retrogression.

Just a suggestion, sooner or later that's the way it should be. No offense taken.
This has been requested earlier.
But pls understand that if IV is transparent in its lobbying power , this might be an indication to our opponents to raise their funding drive.
Its all about Money in US and its lobbying power, hence it is not going to help in anyway for us.
As far as I know, no other anti-immigration orgnanization is transparent in their funding power.
"Our Strength Lies In Our Affordability To Contribute". This should help us bring success.....

I had my H1 visa appointment on December 27th in Chennai. They said that my visa was approved and that I would recieve my passport within one week. I have not recieved it yet. I called up the Consulate a few times last week and initially they were saying that 'it would take another 2-3 days'. Finally when I called up on Friday the 4th, they said that another 7 days was needed for the PIMS verification.
Still no news......I was supposed to fly out on the 6th to report to work on the 8th but had to postpone my ticket.
Anyone else in the same position please share!
Thanks

I agree it is a completly unfair practice and i am glad it is stopped
----------
that was the idea behind it, but when a feature is being misused and exploited that needs to be plugged. If microsoft needed a genius they can bring that person in on EB1 or H1B or B1 visa. there are many other avenues.
How do u feel that a person who arrives in US yesterday, buys a labor, gets his GC within a year while thousands of us are waiting patiently.
It is an unfair practice and should have been stopped long time back.
It's never too late though.
Selling labors became the business model of manyof these companies.
Are they doing anything illegal? NO.
Are they doing something ethical? NO
So, the law has to change to give everyone a fair chance.

Urging more members to call and keep the momentum going. I will try and ask some of my friends affected by GC to participate in this activity as well.
