I think this is good news, but I am not sure if this will affect me. I have PERM approved labor on my name. I didn't apply for I-140 because I wanted my wife to get F1 visa before doing that. This is because F1 application for my wife can have problem if there is immigration petition and she is beneficiary. I don't know how much time its going to take me to get greencard or work authorization for my wife and I want her to get the advantage of OPT after completing her studies so that she can make her career.
So I guess if this rule comes, I have to apply I-140 immediately? Is this true? Please advice me.

* Since this is a final rule, upon approval by OMB, the elimination of substitution and 45-day validity of certified labor certification will be triggered. Take this message as a very special alert! What is this reverse brain drain ? there is no such thing - folks who are here are going to hang on tooth & nail to stay here come hell or high water - the only ones who are going back are the ones who have no other option.
Or they have way more options than you or me!! Don't envy those guys who move around the world like free birds not thinking twice about leaving the green card process half way, and unlike us they probably will earn more after leaving US. Your post shows lots of frustration..... take it easy man!:D

Yes a new memo was issued in 2009 (After DHS confirmed that they have worked with FBI to reduce the response time.) Now since FBI claims that 90/95% of the requests are happening within 6 months. DHS/USCIS is not allowing automatic approval of GC is FBI check was the only peice pending and was pending for more than 180 days.
I went to Infopass today, unfortunately service rep on counter was totally uncooperative. She did not tell anything other than my background check is still pending. It has been pending for more than six months now. I understand that my PD is not current as of yet but, based on recent movement, I hope to have my date current in next couple of months. But, it may not help me much if BC is still pending..
Any suggestions from IV.. What can I do about it? I planning to get in touch with my attorney but, I don't think they can be of much help..

Just in, Obama Administration wants to change law allowing employee to sue past employers and seek compensation. Current laws allows employee to sue for events up to 24 months in the past. This will change and suing employer is going to be a lot more easier. Bring it on baby, this time employees will be millionaires by suing body-shoppers. I am no longer going waste my money to buy lottery ticket :p

The US constitution guarantees the basic rights enshrined within it to all within its borders irrespective of nationality or immigration status. The claim that the undocumented do not have rights is one propagated by Lou Dobbs and other anti-immigrationists. This is why it is possible for an undocumented worker to file a discrimination complaint with the EEOC and win for example.
You have to see my quote from the context of immigration. I never said illegal immigrants do not have any rights. Human rights are across the board. Every nation must follow these standards. Illegal immigrants can not sneak into a country and then demand that they should be given citizenship.
Regarding undocumented workers filing with EEOC, please quote me few cases like that. I doubt if it is ever possible. In my personal opinion, when such workers are subject to deportation when found, where is the foundation in that case? Are you suggesting that non-citizens can apply for jobs in defence and aviation and complain to EEOC if rejected?
I read few articles about (undocumented) women being exploited by the employers and USCIS/DOL treated these women as victims. That angle was more of human trafficking, not employee-employer relations.

Just finished calling the offices of all the representatives listed for Phase 3. Took me about 15 min to complete it. Left a voice mail for congressman Calvert's office. They staff persons were all very polite and did note down the information and mentioned that they'll pass on the information.
Urging more members to call and keep the momentum going. I will try and ask some of my friends affected by GC to participate in this activity as well.
